Volkswagen sues India to quash ‘enormous’ $1.4 billion tax demand

Skoda Auto Volkswagen India has moved the Mumbai High Court against a $1.4 billion tax demand issued by Indian authorities.

The company confirmed to CNBC-TV18 that it is availing itself of all legal remedies in response to the Show Cause Notice, as permitted under the law.  The story was first reported by Reuters.

In a statement, Skoda Auto Volkswagen India Private Limited (SAVWIPL) reiterated its commitment to operating as a responsible organisation and ensuring full compliance with all applicable global and local laws and regulations. “Compliance with regulatory requirements is one of SAVWIPL’s fundamental principles, and we are cooperating fully with the authorities on this matter,” the company stated.

India slapped a $1.4 billion tax notice on Volkswagen in September for using a strategy to break down imports of some VW, Skoda and Audi cars into many individual parts to pay a lower duty.

The tax notice is “in complete contradiction of the position held by the government … (and) places at peril the very foundation of faith and trust that foreign investors would desire to have in the actions and assurances” of the administration, the Jan 29 court filing states.
